Grand jury indicts man on computer solicitation charges

WINCHESTER -- A Frederick County man charged in an Internet solicitation sex sting in July has been indicted by a Frederick County Circuit Court grand jury.

Marshall Lee Warner III, 38, of 726 Wardensville Grade, Winchester, was indicted Tuesday on one count each of attempted indecent liberties and computer solicitation.

Warner was arrested in July in the parking lot of the Martin's grocery store in Stephens City after allegedly driving there to meet someone he thought was a 14-year-old girl for a sex act, court documents state.

An affidavit for a search warrant filed in the court states that Warner began a conversation on July 7 with Frederick County Sheriff's Office investigator James Galbreath in a Yahoo chat room.

Galbreath was posing as the 14-year-old girl, it says.

"The conversation continued on July 8, 2010 and became sexual in nature," the affidavit states.

Warner was arrested at the grocery store about 10:30 p.m. and "confirmed the details of the chat," the affidavit says.

Galbreath details the conversation in a criminal complaint filed in the court.

Using two screen names -- "chwbcw99" and "Marshall W" -- the suspect asked to see a picture of the "girl" and asked, "have you been alone at your house with just a boy" and "would you like someone to come to your house or meet them somewhere," the complaint states.

On the second day of the conversation, the investigator "was immediately contacted by this same individual at 7:55 p.m.," the complaint states. The suspect suggested a meeting at the Martin's and made a specific sexual request, it says.

In an interview with authorities, Warner "indicated that he was in fact the person involved in the chats, and did intend on meeting the 14-year-old female," the complaint states.

Authorities searched Warner's home after the arrest and seized computers, a cell phone and other items.

Frederick County Juvenile and Domestic Relations Court Judge William Sharp granted Warner a $10,000 secured bond in July. Warner was not incarcerated Tuesday, according to a jail official.

At the July hearing, Sharp was ordered not to leave the state and have no contact with children under the age of 18 except family members.

Warner has a court hearing scheduled for Nov. 16, according to an online database.
